U.S. Customs and Border Protection (CBP) has issued guidance (CSMS #70050970) on Presidential Proclamations 11061 (alcohol), 11062 (dairy), and 11063 (motor vehicles), which exclude a defined list of Canadian products from importation into the United States.

Effective Date and Enforcement:

This prohibition takes effect at 12:01 a.m. Eastern Time on September 29, 2026. Beginning at that time, covered goods may not be admitted into a Foreign Trade Zone (FTZ) or bonded warehouse, transported in bond, or entered for consumption. The guidance further states that any entry containing covered products will be “unconditionally rejected” by CBP.

There is a limited grace period for imported goods. In particular, covered products imported before the September 29, 2026, effective date may still be entered for consumption, including products that were placed in a bonded warehouse or FTZ before the cutoff. Those products, however, remain subject to the existing 50% ad valorem duty under Presidential Proclamations 11046, 11047, and 11048, as applicable.

Affected Tariff Classification Headings:

Pursuant to the guidance, covered Canadian origin goods identified in the Annexes to Presidential Proclamations 11061, 11062, and 11063 are prohibited from importation into the United States. The import exclusions apply to specific commodities listed under the following Harmonized Tariff Schedule (HTS) headings:

  • Alcohol Annex (Presidential Proclamation 11061): 2203, 2204, 2205, 2206, 2207, 2208.
    • Note: For alcoholic beverages, the exclusion applies only if the merchandise meets the applicable scope limitations set in the official Alcohol Annex. Where the scope limitation specifies “Packaged,” the exclusion applies strictly to items packaged in bottles, cans, boxes, kegs, or similar direct-to-consumption containers. Alcoholic beverages that fall outside these scope parameters are not excluded, but remain subject to the 50% tariffs under Proclamation 11046.
  • Dairy Annex (Presidential Proclamation 11062): 0404, 1702, 1703, 2202
  • Motor Vehicles Annex (Presidential Proclamation 11063): 8711

ACE Enforcement and Filing Impacts:

For the Customs Broker community, CBP will also update ACE at 12:01 a.m. Eastern Time on September 29, 2026, to implement the import prohibitions under Presidential Proclamations 11061, 11062 and 11063. Filings involving covered Canadian products will be automatically rejected, with ACE returning error code 239 for FTZ admissions, 335 for cargo release filings, and 886 for entry summary filings, each indicating that the HTS classification is prohibited for the declared country of origin.
